Order: Order by a Customer of a Product offered for sale on the Site and/or of the Subscription Club Vivashop7;

Feature: Each element implemented, accessible and usable within the Site and the Services through their use;

Operator: Company operating various electronic telecommunications networks necessary for access to and use of the Site and the Services where applicable;

Third Party: Means any natural or legal persons not related by ownership or common control to DOTLEAP LTD or other individuals unconnected with DOTLEAP LTD and/or the Customer.
User or “You”: any person acting for purposes that do not fall within the scope of their commercial, industrial, artisanal, liberal or agricultural activity using or accessing the Site.

These Terms have the purpose of defining the conditions and terms of use of the Site.

Article 7. LIABILITY
The liability of DOTLEAP LTD, in its capacity as publisher, cannot be engaged in the event of failure, breakdown, difficulty or interruption of the network or servers or any other event beyond the reasonable control of DOTLEAP LTD, preventing access to the Site or any of its features.
You alone are responsible for your connection equipment to the Site, the proper functioning of your computer equipment and your internet access. You must take all appropriate measures to protect your equipment and your own data, including virus attacks via the Internet. You are also solely responsible for the sites and data you consult.
DOTLEAP LTD cannot be held responsible for legal action against you due to your use of the Site or any service accessible via the Internet and/or your failure to comply with these Terms.

The fact that DOTLEAP LTD does not initiate proceedings upon becoming aware of unauthorized uses does not imply acceptance of such uses and waiver of further action.
Subject to the foregoing, if the User transmits to DOTLEAP LTD or uploads to the Site content, including photographs, texts, videos, illustrations (hereinafter the “Content”), the User grants DOTLEAP LTD a non-exclusive, transferable, sublicensable, royalty-free right to exploit the Content worldwide as it is published on the Site, as well as a license to all intellectual property rights relating to the Content, for the entire legal duration of those rights and worldwide.
The rights thus granted include the right to reproduce, represent, distribute, adapt, modify all or part of the Content by any means, in any form whatsoever and on any medium, for commercial or non-commercial purposes, including advertising.
Article 9. HYPERLINKS
Any information accessible via a link to other sites not edited by DOTLEAP LTD is not under the control of DOTLEAP LTD, which declines all responsibility for their content. Links on the Site directing you to other websites and/or giving access to information on those sites do not engage the responsibility of DOTLEAP LTD.

Article 13. FORCE MAJEURE
The Parties cannot be held liable if the non-performance or delay in the performance of any of their obligations under these Terms results from a case of force majeure, within the meaning of Article 1218 of the Civil Code.
Article 14. LANGUAGE
These Terms are written in French. They are also available in English. In case of difficulty, the French version shall prevail over the English version.
Article 15. GOVERNING LAW
These Terms are governed by English law.
Article 16. COMPLAINTS AND AMICABLE SETTLEMENT OF DISPUTES

Pursuant to Articles L. 611-1 et seq. of the Consumer Code, any consumer dispute may be subject to an amicable settlement by mediation before a consumer mediator.
The mediator chosen by the professional, LMConso, is currently awaiting approval from the CECMC (Commission for Evaluation and Control of Consumer Mediation). The mediator’s contact details will be updated once they are listed among the consumer mediators as provided by Article L. 615-1 of the Consumer Code. Article 17. COMPETENT JURISDICTION
All disputes arising from these Terms, concerning their validity, interpretation, performance, termination, consequences and aftermath, that have not been settled amicably, will be submitted to the competent court under common law rules.
